1. Services Offered
Gardener Eltham provides a range of gardening services, including but not limited to:
- Garden design and layout
- Planting and maintenance
- Lawn care and mowing
- Pruning and trimming
- Pest control
- Seasonal clean-ups
2. Booking and Payment Terms
To schedule a service, customers must:
- Provide accurate contact information
- Specify the services required
- Agree to the quoted price
Payment must be made in full upon completion of the service unless prior arrangements have been made. We accept various payment methods, including cash, credit cards, and bank transfers.
3. Cancellation Policy
Customers may cancel or reschedule a service by providing at least 48 hours notice. Cancellations made within 48 hours of the scheduled service may be subject to a cancellation fee of up to 50% of the total service cost.
In the event of a cancellation by Gardener Eltham, customers will receive a full refund or the option to reschedule the service at no additional cost.
4. Liability and Insurance
Gardener Eltham is insured for public liability. However, customers are responsible for securing their own insurance for any potential damage to property or personal belongings.
We are not liable for:
- Pre-existing conditions in the garden
- Damage resulting from unforeseen weather conditions
- Acts of nature or other force majeure events
5. Customer Obligations
Customers must ensure that:
- All necessary permissions are obtained for the work to be carried out
- The work area is accessible and safe
- Hazardous materials are removed or declared prior to service
6. Modifications to Terms
Gardener Eltham reserves the right to modify these terms and conditions at any time. Customers will be notified of any changes through the official communication channels. Continued use of our services constitutes acceptance of the updated terms.
7. Governing Law
These terms and conditions are governed by and construed in accordance with the laws of the United Kingdom. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts in Eltham.
8. Privacy Policy
Your privacy is important to us. Gardener Eltham will ensure that all personal information provided is kept confidential and used solely for the purpose of delivering our services. We will not share your information with third parties without your consent, except as required by law.
9. Intellectual Property
All content provided by Gardener Eltham, including designs, plans, and written materials, are the intellectual property of the company and may not be reproduced or distributed without prior written permission.
10. Termination
Either party may terminate the service agreement with written notice if the other party breaches any of the terms outlined herein. Upon termination, any outstanding payments for services rendered up to the termination date must be settled immediately.
11. Indemnification
Customers agree to indemnify and hold harmless Gardener Eltham against any claims, damages, or expenses arising from the misuse of our services or violation of these terms and conditions.
12. Force Majeure
Gardener Eltham shall not be liable for any failure to perform its obligations due to causes beyond its reasonable control, including but not limited to natural disasters, wars, or pandemics.
13. Assignment
Customers may not assign or transfer their rights or obligations under these terms without the prior written consent of Gardener Eltham.
14. Severability
If any provision of these terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
15. Entire Agreement
These terms and conditions constitute the entire agreement between the customer and Gardener Eltham and supersede all prior agreements or understandings, whether written or oral.
